ASSUMPTION OF RISK, RELEASE OF LIABILITY & PARTICIPANT ACKNOWLEDGMENT

I understand and acknowledge that participation in Brazilian Jiu-Jitsu, Muay Thai, wrestling, martial arts training, conditioning, drilling, live rolling, pad work, partner exercises, and sparring involves strenuous physical activity and physical contact and carries inherent risks of injury.

These risks include, but are not limited to, bruises, cuts, sprains, strains, fractures, dislocations, dental injuries, eye injuries, joint and ligament injuries, neck and spinal injuries, loss of consciousness, concussion, traumatic brain injury, permanent disability, paralysis, and death. I understand that injuries may occur accidentally or as a result of the actions or inactions of myself, another participant, an instructor, a coach, or another person.

MUAY THAI AND SPARRING

I specifically understand that Muay Thai and other striking activities may involve punches, kicks, knees, elbows, defensive techniques, clinching, throws, and controlled or live sparring. Strikes may contact the head or body and may result in concussion or other serious injury even when protective equipment is properly worn.

I understand that protective equipment, including gloves, shin guards, mouthguards, groin protection, chest protection, and headgear, may reduce certain risks but cannot eliminate the risk of injury, concussion, traumatic brain injury, or death.

I agree to follow all Montrose Brazilian Jiu-Jitsu LLC rules regarding required protective equipment and sparring. I will not participate in sparring unless authorized by an instructor or coach and properly equipped under the gym’s rules.

If Montrose Brazilian Jiu-Jitsu LLC permits me to participate in an activity for which a particular piece of protective equipment is optional, I understand and voluntarily accept the additional risks associated with participating without that optional equipment.

ASSUMPTION OF RISK

I knowingly and voluntarily assume all inherent and reasonably foreseeable risks associated with participation in these activities, whether known or unknown, including risks arising from physical contact with other participants, equipment, training surfaces, or facilities.

I understand that I am responsible for informing instructors of injuries, medical limitations, or symptoms that may affect my ability to train safely. I agree to stop participating and immediately notify an instructor if I experience symptoms including dizziness, confusion, vision changes, headache, nausea, loss of coordination, or other symptoms consistent with concussion or significant injury.

RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by Colorado law, I voluntarily release, waive, and discharge Montrose Brazilian Jiu-Jitsu LLC, its owners, instructors, coaches, employees, agents, volunteers, contractors, and other participants from claims or causes of action arising out of my participation in training or activities, including claims resulting from ordinary negligence, except to the extent such claims cannot legally be waived under Colorado law.

This release is not intended to waive claims that cannot lawfully be waived, including claims arising from conduct that constitutes gross negligence, recklessness, or willful or wanton misconduct.

AGREEMENT TO FOLLOW SAFETY RULES

I agree to comply with instructions from Montrose Brazilian Jiu-Jitsu LLC coaches and instructors concerning training, sparring intensity, partner selection, protective equipment, and safety.

I understand that permission to spar is determined by the coaching staff and that an instructor may prohibit or stop my participation at any time for safety reasons.

I understand that knowingly disregarding gym safety rules may result in my removal from training or suspension of sparring privileges.

MINORS

If the participant is under eighteen years of age, I represent that I am the participant’s parent, legal guardian, or other person legally authorized to execute this agreement. To the extent permitted under Colorado law, I consent to the child’s participation, acknowledge the risks described above, and release the child’s prospective claims for ordinary negligence.

ACKNOWLEDGMENT

I acknowledge that I have read this agreement, understand its terms, understand that I am giving up certain legal rights, and sign it knowingly and voluntarily.
